Sweepstakes Period. “HD Radio - It’s Time to Upgrade” (the “Sweepstakes”) commences at or around 12:00 a.m. (EST) on June 30, 2008 and continues through 11:59 p.m. (EST) on September 28, 2008 (the “Sweepstakes Period”). Sponsor: HD Radio Alliance, 200 E. Basse Rd., San Antonio, TX 78209
Eligibility; Sweepstakes is open to legal residents of the continental United States who are 18 years of age or older as of the date of entry. Employees of the HD Radio Alliance., Alliance member companies, Texas Creative, and their respective affiliated companies and subsidiaries and the immediate families of each are not eligible to enter or win. Void where otherwise prohibited by law.
How To Enter. There are two ways to enter: Method #1: go to hdradio.com/win_iLuv, complete and submit the online entry form during the Sweepstakes Period (“Online Entry(ies)”). Method #2: Using a mobile phone, participants must text the official keyword, UPGRADE or WIN to shortcode 34343 during the Sweepstakes Period (“Text Message Entry(ies)”). By sending a text message to 34343 to enter for a chance to win, you are opting in for future mobile alerts including, but not limited to, mobile rebates, retail sales information, radio station guide information and product feature information. Alerts may be terminated anytime by simply replying STOP to any alert. Standard text messaging rates apply as determined by your service carrier. All Text Messaging entrants must have a text messaging two-way capable phone and digital service in order to enter the Sweepstakes. Text Messaging is not available in all markets. The Sponsor is not responsible for charges you may incur as a result of wireless phone transmissions. Not all wireless phones carry the service necessary to participate. Before entering via Text Messaging, check with your local wireless provider for details on service availability and possible charges. Standard text message and other charges may apply. Participants may enter as many times as they wish but there is a limit of one (1) prize per person. Incomplete or inaccurate entries are void. All entries become the property of Sponsor.
Winner Selection: A random drawing will be held on or about October 6th, 2008 to determine two-hundred (200) winners (the “Winner") from among all eligible entries received.
Winner Notification: Sponsor or its designee will attempt to contact the potential Winner three (3) times by phone on the phone number received. If any potential Winner is unreachable, or if potential Winner does not call back within three (3) business days an alternative winner will be selected. Winner will be required to sign an affidavit of eligibility, publicity release, liability waiver and/or IRS Form W-9 (collectively “Affidavit”) within two (2) days after receipt of such documents or forfeit his/her rights to the Prize. The Sponsor reserves the right to modify the notification procedures in connection with the selection of alternate winners, if any.
Prizes: Two-hundred (200) Grand Prize Winners will receive an iLuv i168 table top HD Radio valued at $89.99.
All elements of the Prizes to be determined by Sponsor. No substitution, transfer of the Prize or cash alternative permitted, except by Sponsor, due to prize unavailability at time of award in which case a prize of equal or greater value will be awarded.
Dispute Resolution; Limitation of Liability. By participating Entrants agree to release The HD Radio Alliance and sponsors, their parent, subsidiary and affiliated companies at every tier and their respective officers, directors, employees, agents, members, from any and all liability, claims, demands, and causes of action for personal injury and/or death, damage, theft, or loss suffered in connection with this Sweepstakes, the awarding of the prize, the use or misuse of the prize or any portion thereof. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. This Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Texas, regardless of principles of conflicts of laws that may require the application of the laws of another jurisdiction. Any action or litigation concerning this Agreement shall take place exclusively in the federal or state courts sitting in San Antonio, TX, and each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each Entrant agrees to service of process by mail or other method acceptable under the laws of the State of Texas. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
General Conditions. All interpretations of these Official Rules and the decisions of Sponsor in all matters related to this Sweepstakes are final and binding. In the event this Sweepstakes is compromised for any reason (including computer virus, tampering, bugs, computer malfunction, fraud, unauthorized intervention or other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupts or impairs the administration, security, fairness or proper play of this Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate this Sweepstakes. Sponsor is not responsible if any Sweepstakes cannot be implemented or prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way in Sponsor’s sole discretion shall be disqualified. In the event of a dispute over who submitted a Text Message Entry, such entry will be declared made by the authorized account holder of the telephone number, pager number or email address submitted at the time of entry. An “authorized account holder” is defined as the natural person who is assigned to a telephone number, pager number or email address by a telephone company, wireless service provider, Internet access provider, Internet service provider, or other organization (e.g. business, educational, government, institution, etc.) that is responsible for assigning telephone numbers, pager numbers, wireless phone numbers, email addresses, for the telephone exchange associated with the submitted telephone or pager number or the domain associated with the submitted telephone, pager number or email address, as applicable. Sponsor reserves the right to disqualify any Entrant for any reason, including without limitation, if that Entrant has not complied with these Official Rules or has interfered, in Sponsor’s’ sole opinion, with the proper conduct of this Sweepstakes. Unless prohibited by law, each Entrant grants Sponsor and its agents and licensees the right to use, display, distribute or publish such Entrant’s name, likeness, photograph, voice, address (city and state), biographical information, and any material based therefrom, or to refrain from so doing, in any manner in any and all media, whether now known or hereafter devised, anywhere in the world in perpetuity for purposes of advertising or trade in promoting or publicizing Sponsor, without compensation. Acceptance of a Prize constitutes a waiver of any claims to compensation, royalties, or other remuneration for such use. Sponsor and its sponsors, affiliates, subsidiaries, respective directors, officers, employees and agents are not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, telephone or Internet servers or providers, computer equipment, software, failure or delay of electronic communications, or traffic congestion on the Internet or at any Web site, or any human error which may occur in the processing of the entries in the Sweepstakes, or any combination thereof, including injury or damage to participants or to any other person's telephone, computer or other equipment related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, or for any reason Sponsor deems it necessary, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes.
